Beh, normalmente quando si tratta d'illegalita di download c'è di mezzo il copyright quindi volevo sapere se ZUN avesse il copyright.
La risposta è SI, ha il copyright e qui sta il mio casino, perchè avere il copyright non vuol dire il divieto di vendita ma bensi le condizioni e termini d'uso dell'autore(che nessuno legge). 1. Don't post endings.
2. Rescaling is okay, but please preserve the images' aspect ratio.
3. Don't make image content edits that are indistinguishable from the
original images.
This includes things like changing the spell card names, recoloring the
images, or add extra bullets that weren't originally there.
* However, this is okay if it's done as a joke and it's clearly stated
that it's a joke.
4. Things like cropping the images or overlaying them with text are no problem.

ZUN ha un proprio copyright particolare......comunque scaricare Touhou non è illegale e, dopo la figura di merda con Disillusion con la mia malinterpretazione, ho spesso un po di tempo per capire il punto 7 che dice che la modifica del suo materiale testi inclusi è vietata(ero molto indeciso se era sul divieto di distribuzione ma poi ho letto una frase sopra e ho capito tutto).

in poche parole, per quanto riguarda i giochi, non potrebbe esserci niente in giro a parte gli screenshots, quindi perché è legale il fatto che qualcuno posti il gioco gratis? e per di più una patch (la traduzione) assolutamente non prevista dal gioco originale e quindi alterante. -

Qui parla della liberta di circolazione. Nel primo pezzo c'è che puoi vendere o distribuire il suo materiale (oltre al fanmade) liberamente ma se hai problemi con il suo materiale lui non si prende la responsabilita. Nel secondo punto dice che sei libero di farci quelche vuoi ma se lui trova la violazione delle sue condizioni lui puo fermare la distribuzione, quindi se non gli andava che facessero le patch poteva bloccarli(è impossibile che non sapia l'esistenza delle traduzioni ENG).

La seconda condizione sembra una contraddizione con la prima, vedi un po tu come interpretarlo.. -

Di recente ZUN ha richiesto agli sviluppatori che fossero tolte le tracks dei suoi ultimi album, come trojan green asteroid, perciò vuol dire che le themes di tutti gli altri giochi possono circolare liberamente . -

Nessuna figura tranquillo, spesso scazzo anchio su qualsiasi argomento Touhou, mi ricordo una volta nel SB in cui dissi che Ran era la sorella di Yukari perchè aveva lo stesso cognome...rofl.
Riguardo ai giochi Touhou, non ho letto ciò che hai postato come quote, poi vedrò con calma, ma in teoria è illegale, lui i giochi che fà li vende, anche se a basso prezzo, non li regala.
Tradurre invece secondo me è libero, difatti se notate, touhouwiki non fornisce nessun download link dei giochi e degli album musicali, ma fornisce liberamente le patch, comprese le traduzioni, completamente legali.
In ogni caso non rischiate nulla, lui non voleva/non vorrebbe far uscire il Touhou dal Giappone, ma era una cosa impossibile da fare, fuori dal Giappone lui non opera direttamente sulla questione, perciò chiunque non stia in Giappone non rischia nulla condividendo i giochi e i vari link di download.. -

Beh hai giustamente detto che i giochi di ZUN sono coperti da copyright, non sono un esperto in materia ma penso che basti quella parola per rendere automaticamente non legale l'upload dei giochi e la diffusione dei link, la domanda e la questione che hai sollevato sono anzi più che giuste. Di sicuro noi qui non corriamo alcun rischio, per il mondo siamo un forum insignificante e innoquo, per youtube non so come funzioni, qualche volta dei video vengono bloccati o rimossi, quindi la cosa non è completamente chiara neanche a me.
Patch e traduzioni sono libere a priori, basti pensare a molti altri giochi più famosi, lo stesso forum di shrinemaiden ha recentemente pubblicato una touhou-patch per Diablo 2, in quel forum vietano i link ai giochi Touhou di ZUN, dato che è un forum mondiale molto conosciuto e frequentato. La spiegazione sta nel fatto che patch e traduzioni non sono modificazioni dirette sui file originali del gioco, ma sono solo delle aggiunte.. -

Poi le varie canzoni presi con le themes di touhou hanno il copyright del gruppo che l'ha prodotto (se hanno richiesto il copyright), forse i video bloccati erano relative ad esso? . -
